Can I use commercial Microsoft 365 for CUI?

Not by itself. Commercial Microsoft 365 does not meet the FedRAMP Moderate baseline DFARS 7012 expects for CUI, and Microsoft does not sign the required commitments on commercial tenants. Options: move CUI to GCC/GCC High, or keep commercial M365 and add a FedRAMP-authorized encrypted overlay like PreVeil.

Your three realistic paths

  • GCC High: the gold standard, required for ITAR/CUI-Specified; highest cost and migration effort
  • GCC: suitable for many CUI Basic cases at lower cost
  • Commercial + overlay (PreVeil/Exostar): CUI lives encrypted inside the overlay; your everyday M365 stays untouched — often the cheapest compliant enclave for SMBs

Backups and email logging must also be CUI-compliant — a commonly missed trap. Map your stack in the CMMC planner.
